Terms of Use for Study in Asia

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE STUDY IN ASIA PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

1. DEFINITIONS

“Intellectual Property Rights” refers to all intellectual property rights, including copyrights, trademarks, patents, design rights, and trade secrets, whether registered or unregistered.

“Fees” means the payments required from users to access certain features or services on the platform.

“Personal Data” refers to any data that identifies or relates to an individual, as outlined under applicable privacy laws.

“Subscription Service” means the services provided by Study in Asia for accessing and applying to university programs during the subscription period.

“System” refers to Study in Asia’s platform, software, and associated tools for connecting students to universities.

“Users” include students, agents, or other authorized individuals using the platform.

“User Information” includes all data provided or generated by users during platform use, such as application details, transcripts, and preferences.

2. SERVICES AND ACCESS

2.1 Subscription Services:

  • Study in Asia grants users a non-exclusive, non-transferable license to access the platform for educational purposes. Users are prohibited from sublicensing, sharing, or transferring access to unauthorized individuals.

2.2 Platform Use:

  • Users must maintain secure login credentials and are responsible for any activity conducted under their accounts.
  • Users agree to provide accurate and up-to-date information and comply with applicable laws when using the platform.

2.3 Privacy and Data Use:

  • Users consent to the collection and processing of their personal data for purposes related to platform functionality, as detailed in the Privacy Policy.
  • Study in Asia may use aggregated and anonymized data for analytics and service improvement.

3. PAYMENTS AND FEES

3.1 Fees:

  • Users must pay applicable fees to access premium services. Fees are non-refundable unless otherwise stated.

3.2 Taxes:

  • Users are responsible for any applicable taxes related to their use of the platform.

4. USER RESPONSIBILITIES

4.1 Users must not:

  • Share or distribute their login credentials.
  • Upload sensitive financial information or data unrelated to program applications.
  • Use the platform for illegal or unauthorized purposes.

4.2 Users are responsible for obtaining all necessary consents for uploading third-party data (e.g., letters of recommendation).

5. TERMINATION AND SUSPENSION

5.1 Termination by Users:

  • Users may terminate their accounts by providing written notice. No refunds will be issued for unused subscription periods.

5.2 Termination by Study in Asia:

  • Study in Asia may suspend or terminate accounts for violations of these terms, including non-payment or unauthorized use.

5.3 Data Access Post-Termination:

  • Users are responsible for downloading their data before termination. Study in Asia will delete user data within a reasonable period post-termination, except as required by law.

6. INTELLECTUAL PROPERTY

6.1 All intellectual property related to the platform, including software and content, remains the exclusive property of Study in Asia.

6.2 Users are prohibited from:

  • Reverse-engineering, duplicating, or creating derivative works from the platform.

7. DISCLAIMERS AND LIABILITY

7.1 No Warranty:

  • The platform is provided “as is” without warranties of any kind, including but not limited to fitness for a particular purpose.

7.2 Limitation of Liability:

  • Study in Asia’s liability is limited to the amount paid by the user in the 12 months preceding the claim.

8. GOVERNING LAW

This agreement is governed by the laws of [Insert Applicable Jurisdiction]. Any disputes will be resolved in the courts of the same jurisdiction.

9. MODIFICATIONS

Study in Asia reserves the right to amend these terms. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the revised terms.
